These Terms of Service ("Terms") govern your use of Clarity Works websites, applications, and related materials (collectively, the "Service") offered by the operator of Clarity Works ("we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Clarity Works provides educational workplace wellness tools, including self-report questionnaires, local summaries, and optional features that may use third-party AI when you are online and choose to use them. The Service is not medical care, therapy, or an emergency service.
Nothing in the Service constitutes medical, psychological, or professional advice, diagnosis, or treatment. If you have health concerns, contact a qualified professional. If you are in crisis or may harm yourself or others, contact local emergency services or a crisis hotline immediately.
You agree to use the Service only in compliance with applicable laws and these Terms. You will not:
Optional features (for example, AI-assisted chat) may rely on third-party providers such as Google Gemini. Your use of those features is also subject to the provider's terms and policies. We do not control third-party services and are not responsible for their availability or practices.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100), IF APPLICABLE LAW ALLOWS SUCH A CAP.
We may update these Terms from time to time. We will post the updated Terms on this page with a revised "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
